The App is a partnership of EveryBody Yoga (Saskatchewan business name registration 102214886), and 13251314 Canada, Inc., a Canadian of Dartmouth, Nova Scotia, Canada.
These Terms are an agreement between you and us. They apply when you create an account, subscribe, watch a class, or post in the community — together, the "Service."
By creating an account you accept these Terms. If you don't accept them, don't create an account.
Our Privacy Policy forms part of these Terms and explains how we handle your information.
Contact: privacy@everybodyyoga.app
The Service is for adults. You must be at least 18 years old to create an account or subscribe. By creating an account you confirm that you are.
If we learn that an account belongs to someone under 18, we will close it and delete the data associated with it.
You sign in with Apple or Google. We never create or hold a password for you.
You're responsible for what happens under your account, and for keeping access to your Apple or Google account secure. Tell us promptly at support@everybodyyoga.app if you think someone else is using yours.
One account, one person. Your subscription is personal to you. Don't share your account or sign-in with anyone else. If we see an account being used by multiple people, we may suspend it.
A subscription gives you access to the full class library and the members' community for as long as it stays active. There is a 7-day free trial after which you will be billed $24.99 CAD per month or $199 CAD per year (price adjusted for your country by Apple & Google). Cancel at anytime via your Apple ID or Google Play account settings.
The subscription costs $24.99 per month CAD or $199 per year CAD. Apple or Google charges you, depending on where you downloaded the app.
Your subscription renews automatically each month or each year until you cancel. Apple or Google will charge you for the next month within 24 hours of the current one ending. That's how app store subscriptions work, and it's what you agree to at purchase.
Cancel any time in your Apple ID or Google Play account settings — not in our app, because we don't control the billing.
Cancel at least 24 hours before your renewal date to avoid being charged for the next month. When you cancel, you keep access until the end of the period you've already paid for. We don't pro-rate part-months.
Cancelling a subscription doesn't delete your account. If you want that too, use Delete Account in the app's settings.
Apple and Google process all payments and all refunds. We never see your payment details and we can't issue a refund directly.
If you want one, request it through Apple or Google. We'll help you make the request, and where we think a refund is fair we'll say so in support of it — but the decision is theirs.
If we change the price, we'll tell you at least 30 days before it takes effect, and the new price will only apply from your next renewal. You can cancel before then. Where the app stores require your explicit consent to a price rise, your subscription won't renew until you give it.
The Service is a library of yoga classes and a members' community.
We add classes over time and occasionally retire them. We don't guarantee that any particular class will remain available, and a class you've saved to a playlist may be removed.
We may change features, and we may add or remove them. If we make a change that substantially reduces what you're paying for, we'll tell you before it happens and you can cancel.
We aim to keep the Service running but we don't promise it will never be unavailable. Maintenance, outages at our hosting providers, and problems at Apple or Google can all interrupt it.
The community exists so that people can practise alongside each other. It works because members treat it as a shared space.
If you see something that breaks these rules, report it in the app. We read every report.
You own what you write. Posting doesn't transfer ownership to us.
You give us permission to store, display, and distribute your posts, comments, and reactions within the Service, so that other members can see them. That permission lasts as long as your content is on the Service and ends when you delete it or close your account.
That's the whole permission. We won't use your posts in advertising, on our website, in marketing emails, or anywhere outside the community, without asking you first.
By posting, you confirm that the content is yours to post, that it doesn't infringe anyone's rights, and that it doesn't break section 7.
You can delete your posts and comments at any time. Deleting removes them from the community going forward — it doesn't reach copies other members have already saved, or your words where someone quoted them in their own post.
We may remove content, and suspend or close an account, where we reasonably believe these Terms have been broken. Moderation decisions are made by a person, not by software.
For a first or minor breach we'll usually remove the content and explain why. Serious breaches — threats, harassment, sharing our content, sexual content involving anyone — may result in immediate closure.
If we remove your content or suspend your account and you think we've got it wrong, email us at support@everybodyyoga.app. A person will review it.
If we close your account for breaching these Terms, you won't receive a refund for the remainder of the period. If we close it for any other reason — we discontinue the Service, for example — we'll help you obtain a refund for the unused portion through Apple or Google.
You can stop at any time: cancel the subscription in your app store settings, and use Delete Account in the app if you want the account and its contents gone.
The classes, videos, images, text, design, and software that make up the Service belong to us or are licensed to us.
What you may do: watch and use the Service for your own personal, non-commercial practice, while your subscription is active.
What you may not do: download, record, screen-capture, copy, republish, share, sell, or publicly perform any class; use any part of the Service to run your own classes, whether paid or free; remove any copyright notice; or reverse-engineer the app.
If you teach yoga, you're welcome as a member — but membership doesn't license you to use our classes in your own teaching.
Please read this section properly. It matters more than anything else here.
EveryBody Yoga is a wellness service, not a healthcare service. We are not doctors, physiotherapists, or licensed healthcare providers, and we are not yours. Nothing in the classes, the community, or anywhere else in the Service is medical advice, diagnosis, or treatment.
We are not a covered entity under HIPAA, and information you share here is not protected health information under that law.
Speak with a qualified healthcare professional before you begin, particularly if you are pregnant or recently gave birth, recovering from injury or surgery, managing a heart condition, high or low blood pressure, joint or spinal problems, an eating disorder, or any chronic illness, or if you're taking medication that affects balance, blood pressure, or heart rate.
If you have a medical condition and you're unsure whether a class is appropriate, ask your doctor — not us and not the community.
Yoga is physical activity and physical activity carries risk of injury.
Our instructors cannot see you. They don't know your body, your history, or how you're feeling today. They can't correct your alignment or tell you to stop.
So the responsibility for how you practise is yours. Move at your own pace. Modify anything that doesn't feel right. Stop if you feel pain, dizziness, breathlessness, or anything that alarms you — and seek medical attention if it doesn't pass.
By using the Service you accept the risks of physical activity and confirm you are physically able to participate.
If you think you're having a medical emergency, call your local emergency number. Never post in the community and wait.
Other members may share what worked for them. That's part of what a community is for — but it isn't professional advice, we don't verify it, and we're not responsible for it. Weigh anything you read here accordingly.
The Service depends on Apple, Google, and our technology providers. Their terms govern their part of it, and their failures aren't within our control. Our Privacy Policy lists who they are and what they do.
The Service is provided as it is. To the fullest extent the law allows, we don't make promises that it will be uninterrupted or error-free, that it will meet your particular goals, that any class suits your body or condition, or that using it will produce any specific result for your health, fitness, flexibility, or wellbeing.
Nothing here excludes any warranty, condition, or right that applicable law does not permit us to exclude. Consumer protection law in your province, territory, or state may give you rights that these Terms cannot take away, and where that's so, those rights apply.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not permit us to limit. Read the rest of this section subject to that.
To the fullest extent the law allows:
We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost opportunity, arising from your use of the Service.
Our total liability to you, for all claims arising in any 12-month period, is limited to the amount you paid us for the Service in that period.
We are not liable for the acts, omissions, or content of other members, or for anything you do as a result of something you read in the community.
If someone brings a claim against us because of something you posted, something you did on the Service, or your breach of these Terms, you agree to cover our reasonable costs in dealing with it. This doesn't apply to the extent the claim results from something we did wrong.
These Terms are governed by the laws of the Province of Saskatchewan and the federal laws of Canada that apply there, and the courts of Nova Scotia have jurisdiction.
If you're a consumer, this doesn't take away your right to bring proceedings where you live, or the protection of consumer law in your own province, territory, or state.
Before going to court, please email us. Most disagreements can be sorted out directly, and we'd rather resolve it than argue about it.
We may update these Terms. If a change materially affects your rights or what you're paying for, we'll tell you in the app or by email at least 30 days before it takes effect, and you can cancel before then if you don't accept it.
Continuing to use the Service after a change takes effect means you accept the updated Terms. We'll always post the current version at everybodyyoga.app/terms with the date it was last updated.
If part of these Terms is unenforceable, the rest still applies.
If we don't enforce something immediately, we haven't given up the right to enforce it later.
You can't transfer your account or these Terms to anyone else. We may transfer them if our business is sold or reorganised, and we'll tell you if that happens.
These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
These Terms are between you and us — not with Apple or Google. Apple and Google are not responsible for the Service or its content.
Apple and Google have no obligation to provide support for the Service. If the app doesn't work as it should, you may tell Apple or Google, and they may refund the purchase price if their policies allow, but they have no further obligation.
If the app fails to conform to any warranty, Apple's or Google's only obligation is to refund what you paid, to the extent the law allows.
We, not Apple or Google, are responsible for handling any claim that the app or your use of it infringes someone's intellectual property rights, and for any product liability or legal compliance claim relating to the app.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
You confirm that you are not located in a country subject to a US Government embargo or designated as supporting terrorism, and that you are not on any US Government list of prohibited or restricted parties.
